​The DOT regulations require that any Safety-Sensitive employee who violates the Drug & Alcohol Regulations must complete a SAP Evaluation. These evaluations are done by DOT Qualified Substance Abuse Professionals (SAPs) In order for an employee to be qualified to take a Return-to-Duty Test, they must comply with the SAPs recommendations.

Federal Regulations

The Federal DOT Drug and Alcohol Testing Regulations (49 CFR Part 40) covers:

 

  • How drug and alcohol testing is conducted

  • Who is authorized to participate in the drug and alcohol testing program

  • What employees must do before they return-to-duty following a drug and/or alcohol violation

 

As an employee, when you have violated DOT drug and alcohol regulations, you cannot again perform any DOT safety-sensitive duties for any employer until, and unless, you complete the SAP evaluation.
